1. Scope

The following terms and conditions apply to all orders placed via our online shop by consumers or traders.

Consumer means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession;

Trader means a person acting for purposes relating to that person’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf.

These terms also apply to traders for future commercial relations without the need for any formal expression thereof. Unless expressly approved by us to the contrary, we cannot accept the contractual validity of any conflicting or complementary general terms and conditions used by any trader.

2. Contractual partner, formation of contract

The purchase contract is concluded with Aerialsilks.eu

The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

3. Contract language, Saving of the contract text

The language available for concluding the contract is English.

We save the text of the contract and forward the order data and our T&Cs to you by e-mail. The text of the contract cannot be accessed via the internet for security reasons.

4. Delivery conditions

We only dispatch goods en route; pick up by the customer is not possible. We do not deliver to post boxes.

 

5. Duties

A buyer from outside the EU covers all export-related costs (including customs clearance costs) as well as tax costs applicable in the country of delivery.

 

6. Payment

 

Cash in advance

We must receive payment in advance before your order can be processed and the goods can be dispatched, unless we have agreed otherwise in advance in writing.

 

 

PayPal

During the ordering process you will be forwarded to PayPal's online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.

Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.

 

7. Retention of title

The goods shall remain our property until full payment is made. For businesses, the following applies additionally: We reserve ownership of the goods until complete settlement of all claims arising from a current business relationship. You may resell reserved goods in ordinary business operations; you shall assign any claims arising from this resale – irrespective of connecting or mixing of the reserved goods with a new item - in the amount of the invoice amount to us in advance, and we accept this assignment. You remain authorised to collect the claims; however, we may likewise collect the claims ourselves, should you fail to fulfil your payment obligations.

8. Damage during delivery

For consumer the following applies: If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

Applicable to traders: The risks of accidental loss or deterioration of the goods will transfer to you once we have submitted the item to the haulier, carrier or other contractor for forwarding to the defined person or establishment. The goods will be deemed to have been approved unless the defect was not detectable on inspection. This shall not apply if a given defect has been deliberately concealed by us.

9. Warranty and guarantees

We are under a legal duty to supply products that are in conformity with this contract. Statutory warranty rights apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product or on distinct information pages in the online shop, if applicable.

10. Code of conduct

All our goods are legal, void-free, legally placed on the market. The exception may be sales of products with aesthetic defects (such as paint chips, scratches, spots, ugly edge), but you will always be informed about it and the price of the product will be lower than the regular one.

 

The visibility of products in the Online Store's offer is not tantamount to their availability and the possibility of fulfilling the order. In the description of individual products, you will find information about the availability of the goods and the expected time of order fulfillment. The lack of the ordered goods in the Online Store's warehouse makes it impossible to complete and deliver the order.

If the stock of the product differs from that on the store's website, and the order is paid for - we will contact you to present various options for solving the problem.


We want the descriptions of the products you buy to be as understandable as possible. If you are not sure about something, please contact us by e-mail or telephone.

11. Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. 

12. Final provisions

If you are a trader, Polish law applies, to the exclusion of the UN Sales Convention. If you are a "company" within the meaning of the Polish Commercial Law public-law legal entity or special public-law fund, the exclusive legal jurisdiction for all disputes from contractual relationships between us and you is our registered office.

 

13. Product return and exchange policy

 

13.1 The customer has the right to:

- 14 days, no reason given, easy return

- Free return shipping for defective or incorrect products, regardless of size.

- Product exchange or refund in 14 days

- 24-months warranty on all products

13.2. In the event of receiving a product other than the one ordered, the customer informs the store about this fact. Contact by email at: aerialsilks.eu@gmail.com. After proving the error, the store undertakes to send the correct product immediately to the customer at the expense of the store.

13.3. Product replacement. If the customer wants to exchange the product, he should first contact the store by e-mail at aerialsilks.eu@gmail.com. The customer sends the exchanged product to the store at his own expense and also covers the cost of shipping the new product. The exchange of the product takes place when the funds for the replacement of the product are credited and after the exchanged product is returned without damage to the store. The replaced product should be sent to the following address:

13.4. The so-called personalized products, which have been prepared for a special customer order, are not subject to exchange and returns.

13.5. Only clean products are subject to exchange and complaints.

13.6. If there is a difference in price between the exchanged products, the difference is covered by the customer. If the new product is cheaper than the replaced one, the store does not return the overpayment to the customer.

13.7. The customer is entitled to withdraw from a distance contract within 14 days of receiving the product. The cost of shipping the product from which the customer withdraws from the purchase lies with the customer. Please contact the store in advance by e-mail aerialsilks.eu@gmail.com in order to notify your withdrawal from the contract. The returned product should not bear traces of use. Please attach the withdrawal form to the package with the returned product, which will contain the following information: buyer's details, order number, order amount, account number for withdrawal of funds. The package should also contain a purchase confirmation (receipt or invoice). The store has 14 days to make a refund if the returned product is unused. 

13.8. Client is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

13.9. Client can be requested to cover the cost of reducing the value of returned products if this is due to use other than checking the characteristics and functionality of the goods.

13.10. If the product was used repeatedly - you have to take into account additional costs. The full amount can be refunded only if the equipment is unused.

13.11.

Client does not have the right to withdraw from the contract in the cases specified in art. 38 of the Act on Consumer Rights, i.e. in particular when the subject of the contract is a product manufactured as a customized order, not available for regular sale.

13.12. All products are warranted for 24 months.

13.13. Depending on the nature of the problem, we may or may not ask you to return the item. If necessary, we will cover all return shipping costs. Replacement - exchange or refund – all together we will find a solution for you. If the defect arises as a result of incorrect use of the product by the customer, we have the right to consider the complaint negative.If the complaint is accepted, we will send a new product or a refund, depending on what is indicated on the form. Only in this case we cover / reimburse the costs of delivery of the advertised goods and we pay for the shipment of the goods without defects. If the complaint is rejected, we send the product back to you. You pay the delivery costs.
